Abstract

In a method for transmitting a desired parameter to a remote location (18), the desired parameter is first communicated to a base transmitter (10). Then, the base transmitter (10) transmits a first radio signal (22) therefrom having an unknown center frequency within a known frequency band. The first radio signal (22) comprises information representative of the desired parameter. At a remote location (18), a remote receiver (16) identifies the center frequency of the first radio signal (22) and tunes the remote receiver (16) to the center frequency thereof so as to facilitate reception of the first radio signal (22) with the remote receiver (16). The information representative of the desired parameter may then be communicated to a desired destination.

85. (New) A method for transmitting a desired parameter from a base station to a remote location, the method comprising the steps of : a) transmitting a first radio signal via pulse position modulation from the base transmitter to a relay transceiver disposed at a location intermediated the base station and the remote location; b) receiving the first radio signal with the relay transceiver; and c) relaying the data via direct sequence spread spectrum modulation from the relay transceiver to the remote location.
86. (New) The method as recited in Claim 85, further comprising the step of transmitting a second radio signal from the remote location to the base station, the second radio signal comprising instructions for regulating operation of at least one device.
87. (New) the method as recited in Claim 85, wherein the step of transmitting a first radio signal comprises transmitting a first radio signal having a duration of less than approximately 100 milliseconds so as to mitigate communications contention. -40-
88. (New) The method as recited in Claim 85, further comprising the steps of: a) compressing data representative of the desired parameter; b) storing the compressed data; and c) transmitting the compressed data to a desired location via telephone at a time when telephone rates are favorable.
89. (New) The method as recited in Claim 85, wherein the step of transmitting a first radio signal comprises transmitting a first radio signal representative of a utility meter reading.
90. (New) A system for transmitting a desired parameter from a base station to a remote location, the system comprising: a) a base transmitter disposed at the base station and configured to transmit a first radio signal via pulse position modulation to a relay transceiver disposed at a location intermediated the base station and the remote location; and b) a relay transceiver configured to receive the pulse position modulated first radio signal and to relay the data via direct sequence spread spectrum modulation from the relay transceiver to the remote location.
91. (New) The system as recited in Claim 90, wherein the relay transmitter is configured to transmit a second radio signal from the remote location to the base station, the second radio signal comprising instructions for regulating operation of at least one device .
92. (New) The system as recited in Claim 90, wherein the base transmitter is configured to transmit a first radio signal having a duration of less than approximately 100 milliseconds so as to mitigate communications contention. -41-

(New) The system as recited in Claim 90, further comprising: a) a circuit for compressing data representative of the desired parameter; and b) a memory for storing the compressed data; c) wherein compressing and storing the data facilitate subsequent transmission of the compressed data to a desired location via telephone at a time when telephone rates are favorable.
94. (New) The system as recited in Claim 90, wherein the base transmitter is configured to transmit a first radio signal representative of a utility meter reading.

STATEMENT UNDER ARTICLE 19
The claims have been amended to conform to the claims allowed in the priority (U.S.) application which were initially rejected based on the same cited references.
Claims 1-84 have been canceled from the application and New Claims 85-94 substituted therefor.
New Claims 85 and 90 substantially recite "transmitting a first radio signal via pulse position modulation from the base transmitter to a relay transceiver... " and "relaying the data via direct sequence spread spectrum modulation from the relay transceiver to the remote location."
Applicant respectfully submits that the mere fact that Gastouniotis has identified a need, i.e., the need to maximize - 43- range while maintaining compliance with F.C.C. regulations, does not mean that any invention which fulfills that need is comptemplated by Gastouniotis.
It is further respectfully submitted that the dependant claims are independently patentable with respect to the independent claim. For example, new Claims 86 and 91 substantially recite "transmitting a second radio signal from the remote location to the base station, the second radio signal comprising instructions for regulating the operation of at least one device . "
Further, New dependant Claims 87 and 92 substantially recite "transmitting a first radio signal having a duration of less than approximately 100 milliseconds so as to mitigate communication contention. "
However, it is respectfully submitted that Gastouniotis et . al . addresses the data rate rather than the duration of the transmission.
Therefore it is respectfully submitted that Gastouniotis et al . neither discloses nor makes obvious "a first radio signal having a duration of less than approximately 100 milliseconds so as to mitigate communications contention, " as substantially recited in new dependant Claims 87 and 92.
Further, new dependant Claims 88 and 93 substantially recite "compressing data representative of a desired parameter, " and "storing the compressed data," and transmitting the compressed data to a desired location via telephone at a time when telephone rates are favorable . "
However, Applicant respectfully submits that even if Gastouniotis et . al . did suggest some means of formatting and storing data until forwarding the data to its final destination, that the particular means of formatting, i.e., compressing, is neither disclosed nor made obvious. Moreover, Gastouniotis et . al . does not teach transmitting the compressed data to a desired location via the telephone at a time when telephone rates are favorable . -44-
Thus, it is respectfully submitted that Gastouniotis et al . neither discloses nor makes obvious "compressing data representative of the desired parameter, " storing the compressed data", and "transmitting the compressed data to a desired location via telephone at a time when telephone rates are favorable , " as substantially recited in new dependant Claims 88 and 93.
In view of the foregoing, new Claims 85-94 are respectfully submitted.
