Fuentes del Derecho en Guatemala

Existen muchas definiciones respecto a las fuentes de Derecho, pero dentro de las definiciones de estas encontramos su principio, origen y causa de algo. Este Conjunto de pautas que lo componen valoraciones, principios morales y doctrina, que establecen la voluntad del legislador, aportando contenidos las normas jurídicas.

En general, la fuente es el principio u origen de una cosa, es el lugar donde nace o se produce algo es decir el origen o la explicación. Cuando hablamos del origen de la norma jurídica nos referimos a los acontecimientos verídicos que le dan comienzo, a las manifestaciones de la voluntad humana o sus usos, incluyendo a las prácticas sociales que la ocasionan, nos referimos desde luego, al origen del mismo objetivo. El término fuente, del latín fons, significado de aquello que constituye el principio, fundamento o nacimiento de algo, en una dimensión que excede la causalidad simple.

There are many definitions regarding the sources of law, but within the definitions of these we find its principle, origin and cause of something. This is a set of guidelines comprising assessments, moral principles and doctrine, which establish the will of the legislator, providing content for the legal rules.

In general, the source is the principle or origin of a thing, it is the place where something is born or produced, i.e. the origin or explanation. When we speak of the origin of the legal norm, we refer to the true events that give rise to it, to the manifestations of human will or its uses, including the social practices that give rise to it, we are referring, of course, to the origin of the objective itself.

The term source, from the Latin fons, means that which constitutes the principle, foundation or birth of something, in a dimension that exceeds simple causality.

En este indispensable sentido, se crean leyes, reglamentos, tratados internacionales de acuerdo al derecho natural necesitado.

Son llamadas fuentes reales o materiales. Son los factores y los componentes en el que se determina el contenido de normas jurídicas como: Culturales, económicos, ideas políticas, ideas morales, religión, éticos, etc.

Las fuentes reales se proyectan de acuerdo al funcionamiento de la sociedad, son normas influenciadas por sus factores sociológicos: •Significación ideal: Es la cual consiste en la idea moral, religioso o económico. •Significación real: Es debido a los acontecimientos o sucesos de carácter diverso.

Son las formas obligadas y predeterminantes que ineludiblemente deben revestir los preceptos de conducta exterior para imponerse socialmente, en virtud de la potencia coercitiva del Estado. Las fuentes formales del derecho son: •Legislación: A través de los órganos del Estado o los poderes públicos se crean y promulgan un conjunto de normativas jurídicas aplicables y organizadas de manera jerárquica. •Costumbres: Se trata de la fuente formal más antigua, es de carácter cultural y conlleva a una serie de conductas que son jurídicamente obligatorias y que se aplican de manera generalizada en una comunidad In this indispensable sense, laws, regulations, international treaties are created in accordance with the necessary natural law.

They are called real or material sources. They are the factors and components in wich the content of legal norms such as: Cultural, economic, political ideas, moral ideas, religión, ethical, etc.

The real sources are projected according to the functioning of society they are essentially influenced by its sociological factors: • Ideal meaning: It is which consists of the moral, religious or economic idea. • Real significance: It is due to events or events of a diverse nature.

They are the obligatory and predetermining forms that the precepts of external conduct must inevitably take in order to impose themselves socially, by virtue of the coercive power of the State. The most important formal sources of law are: •Legislation: Through the organs of the State or the public powers, a set of applicable legal regulations are created and promulgated in a hierarchical manner. •Customs: It is the oldest formal source, it is cultural in nature and leads to a series of behaviors that are legally binding and are widely applied in a community. los asuntos discutidos y presentan dificultad en la integración e interpretación de estas. •Doctrina: Son las interpretaciones u opiniones que hacen los juristas sobre las leyes para aclarar, de manera teórica, las interpretaciones de ciertas normas y sus aplicaciones.

Son toda la semblanza, documentos (inscripciones, papiros, libros, entre otros.) y vestigios que en su santiamén encerraron una norma o ley jurídica, y que le sirve al legislador para tornear novedosas abogacías. Es todo indicio regularmente documental, sobre el sistema jurídico en el trillado, instituciones legales que rigen el comportamiento de los individuos en el actual. En Guatemala son fuentes históricas el Popol Vuh o la casa recoleta de jurisprudencia Indias.
