The West Virginia Board of Massage Therapy is pleased to provide you with our report 

for the fiscal years 2007 and 2008. The report is hereby submitted in compliance with 

statutory requirements. 

The Board is charged with the administration and enforcement of the provisions of 

Chapter 30, Article 37 of the West Virginia Code governing the profession of Massage 

Therapy. This report is submitted in accordance with Chapter 30, Article 1, Section 12 

which requires a financial report of total revenues and expenditures and a complete list of 

names licensed by it during such period. Other information enclosed is a list of the 

current board members, board meeting minutes, a list of schools that offer massage 

therapy programs as well as other pertinent information. 

The West Virginia Massage Therapy Licensure Board continues to strive for maximum 

efficiency in serving the people of West Virginia.

BOARD FUNCTIONS

FUNCTIONS OF THE STATE BOARD OF MASSAGE THERAPY 

The Functional objectives of the State Board of Massage Therapy are to administer the 

provisions of the West Virginia Laws, Rules and Regulations governing the profession of 

Massage Therapy in such a manner as to protect the public’s health, safety and welfare. 

The program of this agency can be generally classified into Administration and 

Enforcement. The Administrative functions include the categories of: 

1. Process and qualify application for licenses 

2. Issue licenses to qualified applicants 

3. Provide educational information 

4. Investigate complaints 

5. Investigate unlicensed activity 

6. Conduct hearings for possible suspension or revocation of license 

7. Renew licenses every two years 

The State Board of Massage Therapy consists of three licensed Massage Therapists, a lay 

person and an Osteopathic Physician or Chiropractor, each appointed by the Governor of 

West Virginia and with the consent of the Senate of the West Virginia Legislature for 

terms staggered initially from the first day of July 1997, the Governor shall appoint three 

members for the term of one year and two members for the term of two years then 

subsequent appointees shall be for a term of two years or until their successors are 

appointed.

Sunday 11-4-07 @ 10:00am 

Members present: Joan Wysong LMT, Chairperson; John Skelton LMT; 

Roland Meffert D.C.; Amy White LMT; Marsha Starr, Board Secretary 

Also present: Anthony Eates, Assistant Attorney General; Lind a Lyter,

Wysong brings the meeting to order. Quorum is established. 

A motion is made by White, seconded by Skelton to approve the Board 

minutes from May 10, 2007. Motion carries. 

A motion is made by Meffert, seconded by White to app rove the Board 

minutes from May 31, 2007. Motion carries. 

A motion is made by Skelton, seconded by White to approve the Board 

minutes from June 11, 2007. Motion carries. 

Ray Lemanski, Program Director for ASIC, speaks to the Board about an 

alternative assessment to the National Board Exam, the MBLEx. 

A discussion of the merits of each exam ensues. 

Starr makes a motion to allow the MBLEx Certification Test as an 

alternative to the National Board Certification Exam, effective immediately. 

Skelton seconds. Motion carries. 

Starr makes a motion to go into executive session. Skelton seconds. Motion 

approved. 

Starr makes a motion to come out of executive session. Meffert seconds. 

Motion carries .

Starr moves to send an investigator to talk to (case # 08 -02) and gather 

information about her injuries. White seconds. Motion approved. 

Skelton moves to table (case # 08 -03) Starr seconds. Motion carries. 

Starr moves for Linda Lyter to contact (ca se # 08-00) to see if he will 

schedule a massage appointment. Meffert seconds. Motion approved. 

Skelton moves for our attorney, Anthony Eates to send a letter asking for 

proof that (case # 06 -08) has applied for the certification test and licensure. 

White seconds. Motion approved. 

Skelton moves to accept a relationship with the Board of Acupuncture in 

which they will share office space and personnel with the Massage Board. 

In return, The Board of Acupuncture will reimburse the Massage Board 5 - 

10% of expenses. This arrangement will become effective potentially as 

soon as Jan. 1, 2008, but no later than July 1, 2008. White seconds. Motion 

approved. 

Starr makes a motion to go into executive session. Meffert seconds. 

Motion approved. 

Starr makes a motion to come out of executive session. White seconds. 


Skelton moves for (case # 07 -10) to remain suspended until disposition of 

the criminal matter. White seconds. Motion approved. 

Election of officers is held. 

Meffert moves for Wysong to remain Chairperson. Skelton seconds. 

Motion carries. 

Meffert moves for Starr to remain Secretary. White seconds. Motion 

approved. 

Linda Lyter presents the financial report. 

Starr makes a motion to pr ovide wallet size license cards on cardstock with 

the State Seal. They will only be issued upon request. White seconds.


A discussion is held concerning Anodyne Therapy. 

Starr moves that Anodyne Therapy does not fall within the scope of massage 

therapy. White seconds. Motion approved. 

White moves to adjourn. Skelton seconds. Motion approved.

Sunday June 29, 2008 @ 10:00 a.m. 

Members present: Joan Wysong LMT, Chairperson; John Skelton, LMT; Roland

Wysong brings the meeting to order. Quorum is established. 

A motion is made by Skelton, seconded by Meffert to accept the minutes from the 

November 4, 2007 meeting. Motion carries. 

A motion is made by Starr, seconded by Meffert, to give Janette Layne until the end of 

the calendar year to obtain her CEUs and extend her license renewal period. Motion 

carries. 

A discussion was held concerning La Meekia Horton, who has requested that her lapsed 

license be reinstated without taking the test. Skelton makes a motion to establish a 

committee to hear Horton’s request. Meffert and White will comprise the committee and 

present the results to the Board. Starr seconds. Motion carries. 

John Dyer has requested that his license be reinstated. He has completed required DUI 

classes, and is on home confinement for six months. Lyter will check into any arrearages 

with Worker’s Compensation. Starr makes a motion to draft a letter to inform Dyer that 

if his Worker’s Compensation is not in arrearage, then his license will be reinstated. 

Seconded by Meffert. Motion carries. 

White makes a motion to go into executive session. Skelton seconds. Motion carries. 

White makes a motion to come out of executive session. Skelton seconds. Motion 

carries. 

Starr moves to close out the following cases: 06-08, 07-00, 07-03, 07-06, 07-09, 07-10, 

08-00, 08-01, 08-03, 08-04 and 08-05. Meffert seconds. Motion carries. 

Starr moves to keep open case # 08-02. Meffert seconds. Motion carries. 

Starr moves to send case #08-06 a certified letter to cease and desist from advertising 

massage services. Skelton seconds. Motion carries.

Lyter will find out if case #08-08 has licensed therapists. 

A discussion was held concerning the recent revision of Rules. A motion is made by 

Skelton, seconded by White to accept the changes. Motion carries. 

A discussion was held concerning inspections of facilities to ensure valid licensure. 

A discussion was held concerning the lymph drainage machine. Lisa Waugh will need 

to apply to the National Certification Board to become an approved CEU provider. 

A discussion was held concerning whether to accept the National Certification 

Examination Candidate Handbook. Members will look into it. 

Lyter gave a review of the financial report. 

Lyter hopes by the end of the year we will be able to do online renewals. Licensees will 

be required to send in a copy of CEU’s for their file.

Welcome to the WV Massage Therapy Licensure process. The Law requires that 

you are licensed to practice massage therapy after June 30, 1998. Please find the 

attached forms required for licensure. 

Please fill out all forms completely, in legible INK print or typewritten form; NO 

pencil. 

For new applicants: Please send the form #1 to your school to be completed. 

This form must include the School’s seal for validation. For new applicants and 

lapsed licensees; submit proof of the successful completion of the National 

Certification Board of Therapeutic Massage and Bodywork (NCBTMB) examination 

or the newly approved Board examination, Massage Bodywork Licensing Exam 

(MBLEx). 

For application using Reciprocity, please provide us with a copy of your current 

license from the State that you practice in along with copies of your current 

continuing education units (certificates) if licensed over two years and proof of 

the successful completion of the NCBTMB or MBLEx exam. 

PLEASE KEEP A FILE AND COPIES OF EVERYTHING THAT YOU 

SEND TO US FOR YOUR RECORDS!! 

You must publicly display your license where you perform massage 

therapy. If that is in more that one location, a copy can be ordered for a fee of 

$10.00. 

Please be aware that for renewal, RE-application or for new applicants who 

have been out of School over two years, you must follow continuing education

guidelines from the National Certification Board for Therapeutic Massage and 

Bodywork (www.ncbtmb.com or 800-296-0664). Records of twenty-four (24) 

hours of C.E.U.’s must include the title of the class, (workshop etc.), the date, 

place, number of hours of instruction, sponsor and the person to call to verify 

attendance. 

You must have at least one (1) C.E.U. in professional ethics every two years. Any 

applicant or licensed massage therapist may be audited every two years. 

Your license will be due for renewal TWO YEARS from the end of 

the month that it was issued.

Two year license fee (initial or reciprocal) $ 200.00 

Two year renewal fee $ 125.00 

Duplicate or replacement license $ 10.00

This Code of Ethics specifies professional standards that allow for the proper discharge of the massage therapist 

and/or bodyworker’s responsibilities to those served. This protects the integrity of the profession and safeguards 

the interest of individual clients. 

Those practitioners who are licensed will exercise professional accountability as to: 

Have a sincere commitment to provide the highest quality of care to those that seek their professional services. 

Represent their qualification honestly, including education and professional affiliations, and provide only those 

services which they are qualified to perform. 

Accurately inform clients, or other health care practitioners, and the public of the sco pe and limitations of their 

discipline. 

Acknowledge the limitations of and contraindications for massa ge and bo dywork and refer clients to approp riate 

health professionals. 

Proved treatment only where there is reasonable expectation that it will be adva ntageous to the client. 

Consistently maintain and improve professional knowledge and competence, striving for professional excellence 

through regular assessment of personal and professional strengths and weaknesses and through continued 

education training. 

Conduct their business and professional activities with honesty and integrity and resp ect the inherent worth of all 

persons. 

Refuse to unjustly discriminate against clients or other ethical health professionals. 

Safeguard the confidentiality of all client information, unless disclosure is required by law, court order, or

Respect the client’s boundaries with regard to privacy, disclosure, exposure, emotional expression, beliefs, and 

client’s reasona ble expectations or pro fessional behavior. Practitioners will respect the client’s autonomy. 

Refuse any gifts or benefits which are intended to influence a referral, decision or treatment that are purely for 

personal gain and not for good o f the client.

EACH MASSAGE THERAPIST MUST COMPLY WITH THE FOLLOWING RULES IN 

ORDER TO BE COMPLIANT WITH CODE 30-37-8: 

Maintain documentation of compliance with all state or local government regulations. 

Massage Therapy shall be conducted only in rooms which are adequately lighted and 

ventilated, and which are kept clean. Restroom facilities must provide toilet with adequate 

toilet tissue available, a sink with hot and cold running water, soap and clean towels. 

Reasonable effort for sanitation shall be maintained for temporary locations such as athletic 

events, or public service fund raisers in temporary venues. 

All equipment and supplies used to perform massage service must be maintained in a safe 

and 

sanitary condition. Lotions, creams, and oils must be kept free of possible bacterial 

contamination. 

All licenses shall wash their hands in hot, soapy water or other antibacterial substance before 

and after each massage therapy treatment. 

All licensees shall launder, before reuse, all materials furnished for the personal use of this 

massage therapy client, such as towels, linens and any other draping materials. 

Before proceeding with the massage of a client, each massage therapist shall have explained 

expected draping techniques and provide the client a clean drape or drapes for the purpose of 

covering the body in accordance with generally accepted standards of practice.

You MUST publicly display your license where you perform massage therapy. If that is in more than one 

location, a photocopy is acceptable for display. 

Please be aware that for renewal of your license in WV you must follow continuing education guidelines 

from the National Certification Board for Therapeutic Massage and Bodywork. Records of twenty-four (24) 

hours of CEU's must include title of the class, (workshop, etc.), the date, place, number of hours of 

instruction, instructor's name, sponsor and the person to call to verify attendance (sponsoring group or 

instructor) and other documentation if requested by the Board. MUST HAVE A COURSE IN ETHICS (at 

least three (3) CEU). Any applicant or licensed massage therapist may be audited every two (2) years.
